Claims: When an Interlining Carrier pulls 340 Transportation’s trailers into Mexico, 340 Transportation’s liability for cargo claims is limited to the extent of Mexican law.
COD Shipments: 340 Transportation will not handle any COD shipments.
Corrected BOL: If re-billing is required due to an incorrect bill of lading, a $35.00 charge will be added to the invoice.
Fuel Surcharge: The Carrier will recover extraordinary fuel costs through fuel surcharges. (DOE Fuel Price Index - $1.10Gallon/5.5Miles a Gallon = Surcharge Percentage). This formula will generate a fuel adjustment factor that will be applied as a percentage increase to linehaul rates. Intermodal loads will be assessed at 75% of the OTR truck fuel surcharge. Any changes or cancellations to this agreement must be in writing and signed by 340 Transportation. Shipper acknowledges that no formal notice is required to implement the surcharge when the DOE Index exceeds $1.181.
Payment Terms: When 340 Transportation has relinquished possession of the trailer and/or its contents prior to collection of charges, credit may be extended, if deemed acceptable, in the amount of such charges. Payment is due within 15 days of invoice date and is payable in US currency. Payments for all invoices not received within terms are subject to interest at the rate of 1.5% per month.
340 Transportation has a right to place a lien on freight in its possession for the total amount owed by the responsible party. This item constitutes notice in writing that failure to pay billed charges may result in a lien on future or previously delivered shipments per California Civil Code Section 3051.5.
Proof of Delivery: Upon customer’s request, an image of the proof of delivery shall accompany each freight bill at a fee of $15.00 per bill.
Released Value: Carrier will not be liable for losses in excess of $100,000.00.
Restricted Commodities: Special arrangements must be made prior ro shipping the following restricted commodities, which include but are not limited to: Asphalt, Carbon Blacks, Coiled Metal Products, Creosote, Explosives, Flammable Liquids, Hazardous Materials, Household Goods, Motor Vehicles, Property of Extraordinary Value, Rolled Paper, Scrap Batteries and Scrap Metals.
Congestion Charge: The Customer will be assessed an additional $300.00 charge on shipments with drops or destinations in the New York City area (Zip Codes 100-108, 110-119).
Driver Delay: The Customer will receive 1 hour free time on any pick-up or delivery if the linehaul rate is less than $1,000, otherwise 2 hours free time will apply. After free time has expired, Customer will be assessed $60.00 per hour or fraction thereof.
Equipment Ordered Not Used: The Customer will be charged $1.95 per mile from last destination to designed pickup, subject to a minimum charge of $200.00.
Milage: The governing publication is PC Miler version 2000.
Load/Unload: For each trailer requiring driver load/unload a $150.00 minimum charge will be assessed. Floor loads and grocery loads are quoted on a per occurrence basis.
Reconsignment: There is a $150.00 charge plus applicable linehaul charges on reconsignments. If returned to origin state and no rates are published, the rate will be $1.95 per mile with a $550.00 minimum.
Redelivery: When a shipment is tendered for delivery, and through no fault of the Carrier, such delivery cannot be accomplished, a charge of $100.00 plus applicable detention and linehaul charges will apply for each time the Carrier returns to effect delivery of the shipment.
Stop in Transit: Stops are negotiated on a per occurrence basis.
Blocking/Bracing: Shipper shall be responsible for proper blocking and bracing for all loads. 340 Transportation can provide limited blocking and bracing services (charges will be determined on a per occurrence basis). If any shipment is refused at any railroad facility for improper blocking and bracing, the Shipper will be responsible for a fine of $150.00, re-delivery and the re-working of the freight.
Detention - Outbound: Origin trailer/containers (if applicable) will be dropped at the Shipper’s location with the following detention schedule:
Free Time: Day of spotting plus 2 days (weekends are free if they fall within the free time).
Free Time: Spotting plus Day 1 and Day 2
$50.00/Day: Day 3 through and including Day 6
$100.00/Day: Day 7 and beyond
Detention - Inbound: Destination trailers/containers are subject to destination detention if they are not received within 24 hours of receipt of notification at destination. The following destination detention schedule will apply:
Free Time: Day of notification plus 1 day (weekends are free if they fall within the free time).
Free Time: Notification of Day 1
$50.00/Day: Day 2 through and including Day 5
$100.00/Day: Day 6 and beyond
Driver Delay: There are 2 hours of free time allowed on any pick-up or delivery. After free time has expired, customer will be assessed $60.00 per hour or fraction thereof.
Equipment Ordered Not Used: The Customer will be assessed a minimum charge of $150.00 or round trip drayage to origin rail facility.
Hazardous Materials: 340 Transportation will not handle any hazardous material loads.
Load/Unload/Assist/Count: The Customer will be assessed $80.00 per hour, or fraction thereof, on any pick-up or delivery, no free time allowed. Driver time starts when driver arrives at Shipper/Consignee.
Overweight Surcharge: Shipper is responsible for any fines resulting from an overweight shipment. An additional $50.00 will be applicable regardless of the violation or the amount of the fine.
Reconsignment: A $150.00 charge will be assessed, plus any applicable linehaul charges, for any reconsignments.
Redelivery: When a shipment is tendered for delivery, and through no fault of the Carrier, such delivery cannot be accomplished, a charge of $100.00 plus applicable detention and linehaul charges will apply for each time the Carrier returns to effect delivery of the shipment.
